Recently, we were given a new legal lecture by Prime Minister Rama and journalists paid by Erion Veliaj, but also some criminal lawyers and other servants of the government, or SPAK defendants.
According to them, in order to respect the presumption of innocence, officials under investigation should not be arrested, and the Veliaj case is called a violation of rights, lobbied in the Senate and Congress, paid articles in the media, attacks and accusations, what has not been cooked up these days, perhaps “by chance”. But let them look the truth in the eye.
In principle, no one has a problem with the presumption of innocence. It is a cornerstone of any legal state. But apparently, in the new political and media interpretation, this principle has an even more revolutionary meaning (as a foundation of the left): if someone is innocent until proven guilty, then why arrest them?
Following this bright political logic, perhaps we should take it a step further. Why arrest the exponents of organized crime? They, too, are, after all, innocent until there is a final decision. So, for legal coherence, they too should be investigated freely, until the day of judgment comes. This would also please Rama’s former opposition minister, now Rilindur, Ylli Manjani.
Only here a small confusion arises, which surprisingly, has escaped this new interpretation: the presumption of innocence is a principle related to guilt, while detention is a security measure related to the risk of destroying evidence, influencing witnesses, or evading justice.
But perhaps these are annoying technical details of the Albanian Criminal Procedure Code, which Sokol Sadushi knows well, but he has come out as a partisan by completely letting himself go, because for some time he held on well. We will explain what happened in the coming days.
To be completely clear, in the new political reality, it seems much simpler: if the arrest worries the government, then the problem is not corruption, the problem is that the justice system is misunderstanding the law./CNA
