Actress Kim Delaney admits she hit a motorcycle but denies being drunk at the time as she responds to a lawsuit over the 2022 hit and run.

Dzhamal Badalov filed a lawsuit against the 64-year-old actress in January 2024, alleging he “suffered injuries as a result of (her) negligence.”

Badalov alleges that Delaney “was driving under the influence of alcohol and, following the collision, intentionally caused additional injury by abandoning the scene without exchanging identifying or insurance information.”

He is seeking punitive damages.

Her fame’s to blame

The NYPD Blue star admitted she was involved in car accident, and that she hit Badalov from behind, but she denies being drunk at the time she fled the scene of the November 2022 collision, according to the Feb. 19 filing obtained by People.

In the court documents, Delaney “explained that she left the scene due to fear for her safety.”

The All My Children alum claims in the filing that “several people had surrounded her and she has a previous history of personal assault in this neighbourhood,” in response to Badalov’s claim that she “caused additional injury” by leaving the scene, according to the publication.

“(Delaney) is an actor who has appeared in television series and movies, and is additionally fearful of any retribution or attack based on perceived celebrity status,” the filing adds.

The actress’ legal team point out in the docs that “there is absolutely no admissible evidence of drinking and driving in this case” as “there was no blood alcohol or breathalyzer test and no law enforcement officer administered any field sobriety tests.”

Delaney’s lawyers scoffed at the request that the actress complete an Alcoholics Anonymous program or a rehab program due to the crash, calling it “an invasion of privacy and a character attack.”

Run-ins with the law over her relationship

Earlier this month, Delaney’s husband, James Morgan, was arrestedafter deputies received at least three separate calls reporting a noise complaint and a verbal disturbance at their Marina del Rey apartment complex.

Morgan, 55, was booked on a misdemeanour charge, but eventually “cited and released.”

That incident came nearly a year after Delaney was accused of attempting to run him over with her car during an altercation — an incident that ended with both of them being arrested.

Neither Delaney nor Morgan faced charges related to the arrest.
